State Requirements Determine Whether an Exemption Applies
A medical device may be labeled for prescription use under FDA requirements without automatically qualifying for a sales-tax exemption.
Prescription status controls how the device may be sold or used; sales-tax treatment is determined separately under each state’s statutes, regulations, administrative guidance, and product definitions.
States Apply Different Product Categories
A state may distinguish among prescription drugs, prosthetic devices, durable medical equipment, mobility-enhancing equipment, disposable supplies, and equipment used by healthcare providers.
The same product may be exempt when sold for use by a named patient, taxable when purchased by a hospital for general use, or exempt only when it meets a narrowly defined statutory category.
Some states also consider who prescribes the product, who purchases it, whether it is used in treating a human being, whether it is permanently implanted, and whether the seller retains required documentation.
An Invoice Description Is Rarely Enough
The invoice description “prescription device” is rarely enough by itself.
Depending on the state and transaction, the seller may need a patient-specific prescription, physician order, exemption certificate, resale certificate, purchaser statement, or other evidence showing that every condition of the exemption has been met.
Documentation Must Support the Specific Transaction
Documentation should connect the product, purchaser, patient or permitted use, and applicable statutory basis.
A general product brochure, FDA classification, 510(k) clearance, or “Rx only” label may support the analysis but may not establish the exemption.
Determine Taxability Before Configuring Invoices
Manufacturers and distributors should determine taxability before configuring invoices or accepting customer exemption claims.
Product tax matrices should address each state, customer type, transaction model, and supporting document.
Records should be retained in a form that can be produced during an audit, with expired, incomplete, or inconsistent certificates identified and corrected.
